This action was brought by plaintiffs to recover damages for the breach of a covenant in a deed executed by appellant and wife to Eliza J. Cullity, under which deed plaintiffs had taken possession of the premises, and thereafter were evicted pursuant to a judgment of the superior court of King connty, rendered in an action in which Thomas Elint and Llewellyn Bixby were plaintiffs and the plaintiffs herein were defendants.
