The plaintiff and all of the defendants except the successful cross-complainant L. D. MacDonald appeal from the judgment and from an order denying their motion for a new trial.

In March, 1906, the plaintiff commenced an action against MacDonald to quiet its alleged title to thirty-three lots in outside land, block 1158, situate in the city and- county of San Francisco. Defendant MacDonald demurred and the records of the case having been destroyed by fire, an amended complaint was filed, pursuant to stipulation of the parties on the last day of October, 1906.
