The. appellants filed their complaint and instituted an action against the appellees, for the purpose of ■preventing the annexation of certain territory to the city of Fort Wayne. The averments show that the appellants had fully complied with all the requirements of the law necessary to authorize the board of county commissioners to order an election to be held, as provided by an act for the incorporation of towns, etc., approved June 11th, 1852. 1 G. & H. 619.
