¶1 On August 9, 2000, the Washington Utilities and Transportation Commission (Commission) approved a settlement by PacifiCorp, the Industrial Customers of Northwest Utilities (ICNU), and the Public Counsel Section of the Washington State Attorney General’s Office (Public Counsel). Incorporating the settlement agreement, the Commission approved a defined schedule for PacifiCorp’s power rate increases. The schedule covered a *822five-year term, ending in 2005. But in 2002, the Commission allowed PacifiCorp to file a general rate increase case.
