David Wichnoski, O.D., P.A., d/b/a Spectrum Eye Care ("Spectrum") (together with Wichnoski RE, LLC, "Plaintiffs"), is a professional corporation engaged in the practice of optometry in Unit 105 ("the unit" or "Plaintiffs' unit") of a commercial condominium building ("the condominium") located at 7615 Colony Road, in Charlotte. Wichnoski RE LLC owns the unit in which Spectrum conducts its optometry practice. Defendant Piedmont Fire Protection Systems, LLC, ("Piedmont") installed the fire sprinkler system in the condominium.
