This action was commenced in the district court of Major county by A. W. Anderson to recover against Alva W. Kelley and Maggie Kelley on a promissory note for $782.51 payable to plaintiff, and to foreclose mortgage on their homestead and other lands given to secure the same. One W. E. Bur-rell was permitted to intervene and assert his .rights under a nrior mortgage upon a portion of said property.
