This cause came on for hearing on the appeal of the defendant-appellant, Armand DeCamillo, from a conviction of a misdemeanor from the Municipal Court of Ashtabula, Ohio. At the time of the hearing on appeal, the State of Ohio, *430through the City Prosecutor, moved the Court for an order striking the bill of exceptions and that said bill of exceptions not be considered in this appeal by reason that said bill of exceptions was not timely filed in accordance with statutes providing therefor.
