The promissory note upon which the action in the Court below was brought, was made by Thomas Flemming at Columbus, (without further designation of place,) on the 15th of April, 1840. It is payable generally, one day after date, to William Hargrove or hearer. It was negotiated, by delivery, to the defendant Cox, and by him indorsed to the plaintiff. The action was brought against the indorser Cox, by Patrick Adams, his indorsee.
