The contract upon which this action was brought, as stated in the complaint, is substantially that the defendant, a forwarding and commission merchant at Sacramento, engaged *599the plaintiff, a teamster, to transport certain goods of one A. Bar, from Sacramento to Austin, in the then Territory of Nevada, and deliver the same to said Bar, and in consideration of the plaintiff’s delivering said goods as aforesaid, the defendant promised to pay the plaintiff, upon presentation, any order or draft that said Bar might draw on the defendant, for the transportation of the goods.
