This suit was instituted in October, 1915, in the lower court by Phares against the bank to recover the penalty prescribed by section 5198, Rev. Statutes of United States (U. S. Comp. St. 1916, § 9759), and in the petition filed in this cause it is alleged that on the 27th day of November, 1912, the bank entered, into a corrupt agreement with Phares, whereby the said bank received and charged a greater sum for the loan of money than 10 per cent, per annum, in that, on said date said bank loaned to him $400 as evidenced by his promissory note of that date whereby on the…
