MEMORANDUM OPINION

Denying the Plaintiff’s Motion to Alter or Amend Judgment

URBINA, District Judge.

I. INTRODUCTION

This matter comes before the court on the plaintiffs motion to alter or amend judgment.1 On May 27, 2004, the defendant filed a motion to amend his answer. Although the plaintiff filed his memorandum in opposition to the defendant’s motion on June 9, 2004, it was not docketed until June 16, 2004.
