Responding to congressional criticism, the Department of Justice prepared an internal report defending its prosecution of appellant for environmental crimes allegedly committed at the Rocky Flats nuclear facility. Although the Department released the text of the report to the public, it withheld a series of supporting documents, mostly inter- and intra-agency memoranda written by Department lawyers.
