This is an insurance declaratory judgment action filed by plaintiff Westport Insurance Corporation (“Westport”). West-port seeks a declaration that it owes no duty to defend or indemnify defendant Black, Davis & Shue Agency, Inc. (“BD & S”) in a civil action pending in the United States District Court for the Southern District of New York. 1 (See Doc. 3 at 1.)
