The National City Bank of Rome, Georgia, filed its petition in the city court of Floyd county against W. S. Gentry Furniture Company, hereinafter referred to as “the company,” and John O. Fowler, alleging that it was and had been since December 24, 1931, the owner of 200 shares of stock in the said company of the par value of $100 per share; that said stock had originally beén issued to W.
