This suit was instituted on the 16th day of March, 1923, by appellee against tire Farmers’ State Bank of Mineóla, Tex., and J. L. Chapman, commissioner of banking of the state of Texas, to establish as a general deposit secured by and payable out of the depositors’ guaranty fund a claim against said bank for $2,000.
