This is an action whereby the plaintiff seeks to recover from the defendants the sum of fifty thousand dollars for damages alleged to have been sustained by him by reason of false imprisonment.

The material allegations of the amended complaint, so far as the gist of the present action is concerned, were denied. Demurrers interposed by defendants were overruled by the eoui’t. When the ease came on for trial the defendant Lyons, the constable, and Palmer, the justice of the peace, moved to strike the amended complaint from the files, so far as they were concerned.
