Appeal by plaintiff, Ella H. A. Stevens, as executrix, etc., from a judgment of the Supreme Court in favor of the defendants, entered in the office of the clerk of the county of New York on the 4th day of March, 1910, upon the decision of the court, rendered after a trial at the New York Special Term, dismissing the supplemental complaint.

Laughlin, J.:
On the 23d day of January, 1908, the plaintiff recovered a judgment against the defendant company, a domestic corporation, for the sum of $6,740.50 for services rendered to it by Charles Ellis Stevens, deceased. Execution was duly issued on the judgment on the 28th day of January, 19Ó8, and returned wholly unsatisfied on the third day of March thereafter.
