The pleadings in this action are unnecessarily framed for the purpose of taking advantage of the provisions of “An Act concerning Civil Actions” (Public Acts of 1893, Chap. 66, p. 237), and for this reason the real cause of action is not set forth in the complaint and no material issue is raised by the answer. The reply alleges the plaintiff’s cause of action, and the rejoinder serves the purpose of an answer.
