ORDER

DOTY, District Judge.

This matter is before the court on the defendants’ motion to' dismiss and, in the alternative, for summary judgment. Defendants assert that plaintiff has failed to come forward with sufficient evidence to avoid summary judgment. Based on a rdview of the file, record and proceedings, herein, and for the reasons stated below, the court grants the defendants’ motion except as to part of the plaintiffs claim for breach of contract.
