— This action was brought by the appellant to recover the amount alleged to be due on a promissory note, of which the following is a copy:

“$5,100.00. Tacoma, Wash., Aug. 13, 1892.-
“Ninety days (without grace) after date, for value received, I promise to pay to the order of S. Warburton, fifty-one hundred dollars, at the Union Savings Bank and *539Trust Company, Tacoma, Wash., with interest from date hereof, at the rate of two per cent, per month until paid.
“In case suit or action be instituted to collect this note or any part thereof, I agree to…
