This ivas a suit by Wüsod, the appellant, against Thomas and Washington Hunter for the foreclosure of two mortgages, and to enforce a vendor’s lien on real estate for the purchase money.

The facts alleged in the complaint are, in substance, as follows: On the 14th of September, 1863, Wilson sold and conveyed to Thomas Hunter, one of the defendants, a tract of laud containing eighty acres, in Cas3 county, Indiana, for the sum of one thousand four hundred dollars, for which Hunter executed to him, of the same date, two promissory notes for seven hundred dollars each, one due December 25th, 1863,…
