DuBOIS, District Judge.
I. BACKGROUND
On June 24, 2003, plaintiff, C. Lamont Smith, filed this action against Thomas J. Condon (“Condon”) and Condon’s employer, IMG Worldwide, Inc. (“IMG”) in the Court of Common Pleas of Philadelphia. Defendants removed the case to this Court on August 26, 2003 based on diversity of citizenship jurisdiction under 28 U.S.C. § 1332.
