The People petition for a writ of mandamus to compel the Tulare County Superior Court to vacate its April 19, 1989, order dismissing real party’s murder case.

On January 27, 1981, the Tulare County District Attorney filed an information in superior court charging real party in interest as follows: count I— murder (Pen. Code, § 187) 1 with use of a firearm (§ 12022.5) and one felony-murder special circumstance (§ 190.2, subd.
