— Judgment unanimously reversed, on the law, and a new trial granted. Memorandum: In the course of his trial on charges of criminal possession of a forged instrument, defendant through his own testimony and that of two other witnesses attempted to show that he was elsewhere than at the scene of the crime when it was committed and that the car he was alleged to have been driving was not in his possession when the crime was committed.
