The defendant is charged with violating sections 1250, 1251 and 1263 of the Education Law of the State of New York, in that on various dates mentioned in the information and in the depositions accompanying same, he attempted to and did diagnose and treat certain persons mentioned in said information and depositions, for human ailments, diseases, pain, etc., and that such acts on his part constituted the practice of medicine in violation of the relevant sections of that law.
