OPINION
MAY, Judge.
James Rose and Robert Underwood appeal the trial court's judgment in favor of Mercantile National Bank of Hammond, as Trustee under Trust Agreement dated June 25, 1975, known as Trust No. 8346, J.R. Construction Co., and Joseph Ramaeci (collectively, "Mereantile"). Rose and Underwood raise seven issues, which we consolidate and restate as:
1. Whether the trial court erred in denying Rose and Underwood's motion for change of venue from the judge;
2. Whether the trial court erred in allowing Mercantile to amend the complaint to add a count for treble damages;
