MEMORANDUM
McLAUGHLIN, District Judge.
This action arises from a warrantless entry and search of the plaintiffs’ home. Pursuant to the Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§ 1346(b), 2671-2680, Abdul Rahim Muhammad, Sharon Muhammad, Kharee Muhammad, and Tanasia Edmunds, brought Pennsylvania tort law claims against the United States. The government has moved to dismiss the complaint for lack of subject matter jurisdiction and for failure to state a claim.1 The plaintiffs have agreed to the dismissal of their detention and reckless conduct claims.
