STATEMENT OF THE CASE

This is a private antitrust action for treble damages undér the Clayton Act, 15 U.S.C. §§13 and 14, brought by appellant, Redel’s, Inc. (hereinafter referred to as “Redel’s”), a former franchised dealer of appellee, General Electric Company (hereinafter referred to as “G.E.”). 1 The district court granted G.E.’s motion for partial summary judgment, holding that all claims arising prior to February 12, 1971, were barred by a general release set forth in the “Dealer Franchise Agreement.” Redel’s application for leave to appeal from an interlocutory…
