W. S. Vernon and C. W. Walcott brought suit in the district court of Wagoner county against Melissa Potter, nee Bird, Clarence Potter, and Bichard Cox, to recover upon a promissory note made to P. L. Newton for the sum of $1,250, and to foreclose a real estate mortgage securing the same, which note and mortgage were subsequently assigned to plaintiffs. The petition is in regular form, and shows, as exhibits, copies of the note and mortgage sued on. The allegation is made that the conditions of the note and mortgage were breached by failure to pay the same at maturity. The…
