This case addresses whether a court of appeals must consider all alternative legal theories raised on appeal, including those not argued at trial, that may serve as a basis to uphold a trial court’s ruling on a motion to suppress. In its sole issue in its petition for discretionary review, the State challenges the court of appeals’s decision reversing the conviction of appellant, Melinda Alford, for driving while intoxicated.
