MEMORANDUM OPINION AND ORDER

STANLEY S. HARRIS, District Judge.

This case now is before the Court on cross-motions for summary judgment. Be fore the Court also is the plaintiffs motion to amend his complaint. The plaintiff, Russell Wayne Anderson, challenges the rule of the defendant, USAir, Inc., which excludes blind persons from the emergency exit row seats on USAir’s commercial aircraft.
