I. INTRODUCTION

This is an action for declaratory judgment in which Colonial Insurance Company of California (“Colonial”) seeks a declaration that it is not obligated to pay the claims of Derek Tumbleson and his family (“Tumblesons”) under the uninsured/underinsured (“UM/UIM”) coverage in the auto insurance policy which Colonial issued to the Tumble-sons.
