Appeal from Pottawattamie District Court. — Hon. W. E. Green, Judge. The defendant appeals from a judgment of conviction on charge of larceny.

The indictment is in the ordinary short form, charging that on or about October 13, 1908, the defendant did wilfully, unlawfully, and feloniously take, *634steal, and carry away $30,000 lawful money of tbe United States belonging to one T. W. Ballew. To this accusation tbe defendant entered a plea of not guilty.

It is the theory of the state that defendant, with several other jiersons, entered into a conspiracy to defraud whomsoever they might be able to deceive by means- of pretended horse races, upon the result of which the victims of the deception were to be induced to stake or. risk their…
