Appeal by the plaintiff, John D. Park & Sons Company, a corporation organized under the laws of the State of Kentucky, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 29tli day of November, 1897, striking out parts of the complaint as irrelevant and redundant.

Rumsey, J.:

The plaintiff is a corporation engaged in the manufacture of proprietary medicines which it sells to retailers, and is also a wholesale dealer in other medicines than those which it manufactures. The defendant the National Wholesale Druggists’ Association is an unincorporated association composed of the other defendants in this case and many other persons residing and doing business in different parts of the United States, all of whom are either wholesale druggists who own and manufacture certain proprietary goods, proprietors of proprietary goods who manufacture their own…
