WESLEY W. STEEN, Bankruptcy Judge. Summary

The issue presented in this case is whether a chapter 13 debtor can modify the chapter 13 plan after confirmation to add a prepetition unsecured creditor who was inadvertently omitted when the case was filed.

The Court confirmed the chapter 13 plan in this case in February, 1995. Three years later, Debtors filed a motion to modify the plan to add a prepetition claim asserted by Dionisio and Carmen Solis (“Customers”).
