CIVIL PROCEDURE – DEFAULT JUDGMENT Where the circuit court issues an order of default at the plaintiff’s request and denies a defendant’s motion to vacate the order of default, and the plaintiff subsequently files an amended complaint that asserts a new or additional claim for relief, the court may not enter a default judgment with respect to the amended complaint solely on account of the defendant’s failure to file a timely response to the original complaint.
