This case arises out of the same facts which were involved in Staples v. The Public Service Commission, 79 Pa. Superior Ct. 6. The parties complainant are different — the Borough of White Haven being a party in the present appeal, but the legal questions are identical. The appellant’s position is clearly and strongly stated in the brief filed and is in substance that the Act of February 27,1865, P. L. 203, incorporating the White Haven Water Company, and the action of the Borough of White Haven conveying its water works to the new corporation created a contract1…
