This appeal comes to this court on questions of law from a decision of conviction, judgment and sentence by a three-judge court sitting in Stark County. The charges were set out in an indictment containing two counts, each charging murder in the first degree. The first count charged the defendant with the purposeful killing of one Howard Franklin Riddle with deliberate and premeditated malice. This count was based on the provisions of Section 2901.01, Revised Code.
