Columbia National Insurance Company brought a declaratory judgment action to determine its obligations, pursuant to a business owner’s liability insurance policy, to defend or indemnify parties in a wrongful death and personal injury (“wrongful death”) action. Columbia moved for summary judgment in the declaratory action, which the trial court granted, finding that Columbia had no duty to defend or indemnify parties in the wrongful death action.
