Appeals (1) from a judgment of the County Court of Columbia County (Czajka, J.), rendered November 1, 2000, convicting defendant upon his plea of guilty of the crimes of rape in the second degree (three counts), sodomy in the second degree, sexual abuse in the second degree (four counts) and endangering the welfare of a child, and (2) by permission, from an order *658of said court, entered April 5, 2002, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment of conviction, without a hearing.
