The defendant was convicted of murder in the first degree, and appeals.

On the evening of March 18, 1919, as C. P. Jehu was preparing to close his grocery store in Kansas City, Kan., George Becker rushed in at the front door, flourishing a revolver, and said, “Stick them up, boys; no fooling; we mean business.” Several persons were in the store, and Becker’s command was obeyed by all except Jehu.
