Grant v. Smith

This is an appeal from a District Court Order denying relief to plaintiff blacks under 42 U.S.C.A. §§ 1981 and 19821 and 42 U.S.C.A. § 30642 for defendants’ alleged refusal to rent or sell them a house. Defendants also appeal from the order denying recovery upon their counterclaim for rental value of property temporarily enjoined by the court pursuant to the Fair Housing Act. For reasons indicated below, we remand for additional findings of fact both the main action and the counterclaim.
