This appeal involves interpretation of Fed.R.Civ.P. 65(c) (“Rule 65(c)”), which requires an applicant for injunctive relief to post a security bond to cover “payment of such costs and damages as may be incurred or suffered by any party who is found to have been wrongfully enjoined or restrained.” Appellees, the State of Alabama and three individual plaintiffs who are Alabama citizens (hereinafter “Alabama”), obtained preliminary and permanent injunctive relief in the district court against the appellant United States Environmental Protection Agency (“EPA”) and were…
