On May 5, 1938, George L. Nelson, the plaintiff below (and hereinafter called plaintiff), sued The Nashville Agricultural & Normal Institute, Rural Educational Association, and The Layman Foundation, to recover damages in the sum of twenty-five thousand dollars, for injuries to his person, and thereafter, on October 3, 1938, filed his declaration in which he averred, among other .things, that one Lloyd Levison, an agent and employee of the defendants, while engaged within the scope of his said employment, under circumstances stated in the declaration, negligently, carelessly and wrongfully…
