This appeal involves a case in which the beneficiary in an accident policy sued to recover the accidental death benefit.

The plaintiff-appellant, to whom we will hereinafter refer as plaintiff, sued the defendant-appellee, to which we will hereinafter refer as the defendant, and alleged in her declaration that she is the widow of Jerry Thomas Nicholas, who died on or about June 17,1968; that at the time of his death there was in full force and effect a policy of insurance issued by defendant contracting to pay $12,000.00 to plaintiff in the event of accidental death of her said husband.
