McWhorter, Judge:

Edward Hogan brought his action of trespass on the case in the circuit court of Harrison county against the Clarks-burg Hospital Company, a corporation. The defendant demurred to plaintiff’s declaration, which demurrer was overruled, the defendant then pleaded not guilty and a jury was empannelled to try the case. When the evidence of the plaintiff was all in the defendant moved the court to strike out the plaintiff’s evidence, which motion the court sustained and the jury returned a verdict for the defendant.'
