This is the second time this case has been before this court. Our prior opinion, which denied any recovery to plaintiff and which dismissed his petition, is found in Jackson v. United States, 213 Ct.Cl. 354, 551 F.2d 282, vacated and remanded, 434 U.S. 947 (1977).

The facts show that the plaintiff enlisted in the United States Army Reserve on January 24, 1974, for a period of 6 years. At that time he signed the following enlistment documents:(1) Department of Defense Form 4 (DD4), Enlistment Contract - Armed Forces of the United States.
