Max Siegel brought suit against the Detroit City Ice & Fuel Company,' a Michigan corporation, herein referred to as the ice company and Bernard L. Kilbride and Leland G-. Hillier, individually and as copartners doing, business as Alhambra Theatre Company, herein referred to as the theater company, defendants, to recover damages for personal injuries resulting from an accident on December 14, 1941, caused by defendants’ alleged negligence.
