MEMORANDUM

ALETA A. TRAUGER, District Judge.

Pending before the court is a Motion to Dismiss the First Amended Complaint filed by defendant Doctor R. Crants, Jr. (Docket No. 150), and a Motion to Dismiss the First Amended Complaint filed by defendant Doctor R. Crants, III (Docket No. 156) For the reasons discussed herein, Crants, Jr.’s motion will be denied, and Crants Ill’s motion will be denied in part. In order to rule on the remainder of Crants Ill’s motion, further briefing will be required.
