The trial court having found that the settlement made between plaintiff and defendant “ was not the offspring of fraud,” but was made by the trustees of the plaintiff and the defendant in good faith, that the value of the property transferred was not greater than the claim of the indebtedness of the plaintiff to the defendant, and the judgment having been affirmed at General Term, the only ground upon which it can be attacked in this court is that the trustees had no power or authority to make such settlement and transfer of its property.
